Employment and Labour Court Thursday blocked the planned layoffs at Tuskys Supermarket following a petition by the Kenya Union of Commercial, Food and Allied Workers (KUCFAW).

Kucfaw had moved to court seeking to bar the cash strapped retailer from declaring over 400 employees redundant in a case filed at the court under a certificate of urgency.

In response, Justice Stephen Radido ordered that “Pending the hearing of the motion, interpartes and or further directions, an order, do hereby issue restraining the respondent from further declaring any redundancies unlawfully and/or unprocedurally.”

The worker’s union said the redundancies go against the Collective Bargain Agreement (CBA) signed on March 2017 which requires the employer to serve notice of the intention to declare redundancies.

The matter will proceed on October 8.
