The Kenya Medical Practitioners and Dentists Board (KMPDB) has lifted the prohibition on post-abortion care at Marie Stopes clinics, affirming that the clinics perform the procedure in accordance with the law.
However, Marie Stopes has been warned by Prof. George Magoha, Chairman of KMPDB, against providing abortion services on demand. He stated, “Marie Stopes Kenya is instructed to operate within the confines of the Constitution of Kenya.”
Marie Stopes Kenya is also required to submit a letter of commitment to adhere to this order within the next seven days.
Sicily Kariuki, Cabinet Secretary Ministry of Health, directed the KMPDB to regularly supervise the operations of Marie Stopes Kenya and report to her office.
The Federation of Women Lawyers (FIDA Kenya) applauded the decision, calling it “A win for the women of Kenya.”
Previously in November, Marie Stopes clinics services were suspended due to allegations of performing abortions on underage girls.
In Kenya, according to Article 26, abortion is legally permitted when a woman’s health or life is at risk. It states, “Abortion is not permitted unless, in the opinion of a trained health professional, there is a need for emergency treatment or the life or health of the mother is in danger, or if permitted by any other written law.”
